These Terms of Service ("Terms") are entered into between Falcon AI LLC, a Dubai Free Zone company ("Company," "we," "us," or "our") and the individual or entity accessing or using Falcon AI's transportation management software-as-a-service platform, including AI-powered dispatch tools ("Service"), on behalf of themselves or their company ("User," "you," or "your").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Falcon AI provides a cloud-based transportation management system ("TMS") that offers AI-powered dispatch, load matching, carrier vetting, compliance tracking, and related logistics management tools for freight brokers, shippers, and carriers operating in the United States.
Program Name: Falcon AI TMS Notifications
Program Purpose: By providing your phone number and opting in, you consent to receive SMS text messages from Falcon AI LLC related to: load status updates, dispatch confirmations, carrier alerts, compliance reminders, account notifications, and service-related communications regarding your use of the Falcon AI TMS platform.
Message Frequency: Message frequency varies based on your account activity and service usage. You may receive up to 10 messages per week depending on active loads and platform events.
To Stop Messages: Text STOP to any message to cancel. You will receive one final confirmation message confirming your opt-out. No further messages will be sent.
For Help: Text HELP for help, or contact us at support@falconai.llc or call our support line.
Rates: Message and data rates may apply. Check with your mobile carrier for details.
Carriers: Supported on all major US carriers. Carrier is not liable for delayed or undelivered messages.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may use the Service solely for lawful business purposes in connection with freight brokerage, transportation management, and logistics operations. You agree not to:
Access to certain features of the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process data in accordance with our Privacy Policy and applicable data protection laws.
The Service and its original content, features, and functionality are owned by Falcon AI LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FALCON AI LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
